MAHLER REALTY ADVISORS, INC. ("Company," "we," "our," or "us") provides these Terms and Conditions to govern your access to our website and our professional operative building, general contracting, and real estate services. By authorizing site work, signing a speculative home purchase agreement, scheduling a design consultation, or using our digital client portals, you ("Client," "you," or "your") agree to be bound by these Terms and Conditions in their entirety. If you do not agree with any part of these terms, you must not utilize our home building services.
We provide comprehensive general contracting and operative building services focused on speculative single-family houses for residential buyers and investors. This includes, but is not limited to: land development, architectural floor plan design, framing, interior finishes, and complete home construction. The specific scope of our contracting work, heavy machinery deployed, and materials used for your property will be defined exclusively by a separate, fully executed written construction or purchase agreement.
All home construction and contracting estimates provided by our team are valid for 30 days. Final construction costs may vary if hidden subterranean conditions or undisclosed zoning restrictions are discovered during our site excavation (e.g., massive granite ledge, high water tables, or poor soil compaction common in Connecticut). Any major deviations from the original floor plan require a formal, written change order approved by the Client.
Clients are strictly responsible for funding their projects according to the payment schedule outlined in their specific contract or escrow agreement. Deposits are generally required before our crews begin ordering bulk construction materials (e.g., lumber, custom cabinetry, or roofing). In accordance with state law, we reserve the right to apply a statutory mechanic's lien under Connecticut law to the property for unpaid contracting fees, labor, or construction materials.
The Client agrees to provide our construction crews, excavators, and subcontractors with safe, unobstructed access to the property during scheduled construction hours. The Client is strictly responsible for unlocking gates, securing pets, and staying clear of the active construction zone prior to our arrival for site development.
While we strive to adhere to estimated construction timelines, all outdoor building dates are approximate. The Company shall not be held liable for delays caused by factors beyond our reasonable control, specifically severe New England weather conditions (e.g., heavy rain, blizzards, or frozen ground creating unsafe conditions for foundation pouring or heavy equipment operation).
During active home construction, Clients, their children, and their guests must maintain a safe distance from our heavy machinery, open trenches, and active framing zones at all times. Unescorted visits to the active jobsite are strictly prohibited for liability reasons. All construction equipment provided by the Company is to be operated exclusively by our trained staff.
You agree to accurately identify property lines and authorize excavation work only if you are the legal owner of the site. Crucially, the Client is responsible for disclosing the location of all private underground utilities prior to any earthwork, including private septic lines, well components, and private lighting wires. The Company is explicitly not responsible for damage to unmarked private subterranean lines. We will contact Connecticut Call Before You Dig (CBYD 811) for public utility locates as required by law prior to major excavation.
The Company maintains comprehensive professional and general liability insurance. However, to the fullest extent permitted by law, our aggregate liability arising out of any operative building project is strictly limited to the direct cost of correcting our specific scope of work under the Connecticut new home warranty. We are explicitly not responsible for pre-existing structural issues on renovation projects, damage caused by natural settling, or any indirect, incidental, consequential, or punitive damages.

These Terms and Conditions and all operative building contracts shall be governed by and construed in accordance with the laws of the State of Connecticut, without regard to its conflict of law principles. Any legal disputes arising from our services must be resolved through good faith negotiation. If litigation becomes necessary, both parties consent to the exclusive jurisdiction of the state courts located in Waterbury, Connecticut.
You agree to fully indemnify and hold harmless MAHLER REALTY ADVISORS, INC., its general contractors, crews, and staff from any claims, damages, or liabilities arising from your failure to secure necessary Homeowner Association (HOA) architectural approvals, or your failure to disclose private underground utilities. If any provision of these Terms is found by a court to be unenforceable, that specific provision shall be limited to the minimum extent necessary so that the remainder of these Terms shall remain in full legal effect.
